Cincinnati Domestic Violence and Restraining Orders Lawyers

The courts and the law enforcement officers of Kentucky and Ohio take allegations of domestic violence seriously. Protective orders are available to the victim of domestic violence; these are orders from a judge requiring the perpetrator to keep away from the victim.

Protection Orders and Restraining Orders: The Basics

In Ohio: Keep-away orders between people who are related are called domestic violence orders. Ohio law also has a form of restraining order available between people who are not related. These are called civil protection orders and are similar to an anti-stalking order.

In Kentucky: Restraining orders are only available between people who are married, who are family members, or who are members of an unmarried couple. The first type of order available is called an emergency protection order, which lasts for 14 days. During that time, there will be a hearing determine if an act of domestic violence did occur and that a threat of future domestic violence exists. If the burden of proof is met, then the domestic violence victim will get a domestic violence order, which lasts for as long as three years.
